21-Year-Old Charged with Murdering Father Refuses to Appear in Court, Again

Judge plans to authorize 'force' to get Yashesh Desai to court, if needed.

A DuPage County judge on Friday would sign off on the “use of force” in order to get murder suspect Yashesh Desai to court.

He was subsequently charged with biting a jail guard attempting to remove Desai from his cell. Desai was but has not attended recent hearings.

“The defendant is refusing to come to court,” Judge Robert Kleeman told attorneys.

Kleeman said he would authorize the “use of force” to assure Desai, currently held on $2.2 million bail, makes it to court as attorneys discuss a mental fitness evaluation and his ability to understand court proceedings. Prosecutors on Friday said they have received the results of a court-ordered evaluation.

Court documents state there is “bona fide” doubt about Desai’s fitness to stand trial.

Kleeman set a hearing for Nov. 4 on both the murder and aggravated battery charges. Desai has been indicted in each case, but has yet to enter a formal plea because of absences from court.

Prosecutors allege Desai struck his father, Sanjiv, in the head several times with a weed trimmer causing fatal head injuries. Police responded to a 911 call from a person who said his father had been killed and found Sanjiv Desai lying on a futon.

While being held in DuPage County Jail, Desai reportedly defecated inside his cell and then bit and broke a jail guard’s finger as he tried to move Desai, according to prosecutors.
